About these terms

These Terms of Use govern your use of the Palette website (the “Site”), operated by Artnode Services Limited, a company registered in England and Wales (company number 16297945), registered office 76 St Johns Road, Tunbridge Wells, TN4 9PH, United Kingdom (“Palette”, “we”, “us”, “our”).

These terms apply to the Site only. If you’re a client using the Palette art logistics management platform, your use of the platform is governed by a separate agreement between you (or your organisation) and Artnode Services Limited — not by these terms.

These terms apply when you access or use the Site and should be read together with our Privacy Policy and Cookie Policy, which also apply to your use of the Site and explain how we handle your personal information. Please read them before using the Site. If you do not accept them, you should stop using the Site. 

Using the Site

You may use the Site to learn about Palette’s services, get in touch with us, and request a demo. You agree not to:

• Use the Site in any way that breaches applicable law

• Attempt to gain unauthorised access to the Site or any systems connected to it

• Use any automated system, such as scraping tools or bots, to extract data from the Site without our permission

• Introduce viruses, malware or other harmful material

Intellectual property

The Site and its content — including text, graphics, logos, branding and the “Palette” name — belong to Artnode Limited (16203755), the parent company of Artnode Services Limited, or our licensors, and are protected by copyright, trademark and other intellectual property laws. You may view, download and print reasonable extracts from the Site for your own personal use or your organisation’s internal business purposes, but you may not otherwise reproduce, republish or distribute any content without our written permission.

Accuracy of information

We try to keep the information on the Site accurate and up to date, but we make no promises about its completeness or accuracy, and it shouldn’t be relied on as professional or legal advice. The services provided to a client are governed by the applicable written agreement with that client, which may differ from the general information presented on the Site.

Links to other sites

Our Site may include links to third-party websites, including partner organisations whose logos we display. These links are provided for your information and convenience only. We don't control these third-party sites and we're not responsible for their content, accuracy, or availability. You access any third-party site at your own risk.

You may link to the Site in a fair and lawful way that does not damage our reputation or suggest an association, approval or endorsement where none exists. We may withdraw linking permission at any time.

Platform terms and compliance information

Our platform terms of service, data processing agreement, and security and compliance information are available at our Trust Centre. Our Trust Centre is hosted through an independent third-party service and provides access to legal, privacy, security and compliance information relevant to the Palette platform.

Availability

We aim to keep the Site available and functioning properly, but we don’t guarantee it will always be available, uninterrupted, or error-free. We may suspend, withdraw or change the Site at any time.

Liability

The Site is provided for general information only and does not constitute an offer, professional advice, or a binding description of the services we provide. Where you have entered into a written agreement with us for the Palette platform, that agreement governs the services provided to you and takes precedence over any general information on the Site. If you use the Site for business purposes, we will not be liable for loss of profit, revenue, business, opportunity, anticipated savings or goodwill, or for indirect or consequential loss. Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing in these terms affects any statutory rights available to consumers.

Changes to these terms

We may update these terms from time to time. The revised terms will apply from the date they are published on the Site. Where changes are material, we may provide an additional notice on the Site.

Governing law

If you use the Site for business purposes, these terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer, you may also have the right to bring proceedings in the part of the United Kingdom or other jurisdiction in which you live.
